This document (as well as all other documents mentioned here) regulates the conditions that govern the use of this Website (www.recambiosyaccesoriosbmw.com) and the purchase or acquisition of products and/or services therein (hereinafter, Conditions).

For the purposes of these Conditions, it is understood that the activity that GERMANY VIC SHOP SLU carries out through the Website includes:

• Sale of new and/or second-hand spare parts, parts and accessories, original and compatible, for vehicles BMW, MINI and BMW Motorrad motorcycles.

Without exception, GERMANY VIC SHOP SLU does not carry out installations. It only advises during assembly free of charge (under the express request of the user, availability of the company and GERMANY VIC SHOP SLU reserves the right not to accept or carry out said advice). Just as GERMANY VIC SHOP SLU is not responsible for costs derived from installation, set-up, travel, labor, etc.

In addition to reading these Conditions, before accessing, browsing and/or using this website, the User must have read the privacy and data protection policy from GERMANY VIC SHOP SLU. By using this Website or by making and/or requesting the acquisition of a product and/or service through it, the User agrees to be bound by these Conditions and by everything mentioned above, so if you do not agree with all of this, you should not use this Website.

The User assumes responsibility for correct use of the Website. This responsibility will extend to:

3. PURCHASE OR ACQUISITION PROCESS

During the purchasing process, in the cart, there is a section where the vehicle's chassis number must be indicated. If this number is not provided when purchasing parts, we will not be able to verify compatibility with your vehicle.

Mandatory chassis number and return restrictions

To ensure compatibility of the products with your vehicle, the buyer You must indicate the chassis number (VIN) when purchasing.

If the buyer does not provide the chassis number when purchasing a part, it will be understood that they have made the purchase without verifying its compatibility with their vehicle, assuming the risk of error. In this case, Withdrawal will only apply within a period of 14 calendar days., as long as the product has not been used and is returned in its original packaging. Returns will not be accepted if the product has been installed, tampered with or if it is a custom configured item, in accordance with article 103.c of the TRLGDCU.

The buyer is solely responsible for ensuring that the purchased part is compatible with his or her vehicle. If in doubt, it is recommended to consult with our team before making the purchase.

Duly registered Users can purchase on the Website by the established means and forms. They must follow the online purchase and/or acquisition procedure of www.recambiosyaccesoriosbmw.com, during which various products and/or services can be selected and added to the cart, basket or final purchase space and, finally, click on "Finish the order".

Likewise, the User must fill out and/or verify the information requested at each step, although, during the purchase process, before making the payment, the purchase data can be modified.

5. PRICES AND PAYMENT

However, and unless otherwise specifically indicated, the prices of the items offered exclude shipping costs, which will be added to the total amount due when managing the shipping procedure.

If at any time "free shipping" is indicated, this will only apply to the most economical shipping method even if the website allows you to choose express shipping.

In no case will the Website add additional costs to the price of a product or service automatically, but only those that the User has voluntarily and freely selected and chosen.

Prices may change at any time, but possible changes will not affect orders or purchases for which the User has already received confirmation.

The accepted payment methods will be: Bank transfer, credit/debit cards and Bizum.

Likewise, the User may pay all or part of the purchase price with a gift card issued by GERMANY VIC SHOP SLU.

GERMANY VIC SHOP SLU uses all means to guarantee the confidentiality and security of payment data transmitted by the User during transactions through the Website (SSL).

Orders via bank transfer will be reserved for 5 calendar days. If the payment method is a gift card, the charge will be made at the time of confirmation.

In case of unjustified chargeback or return of payment without legitimate cause, GERMANY VIC SHOP SLU reserves the right to take the necessary legal actions to recover the amount owed. In this case, the user will be informed of the associated costs before starting any procedure. GERMANY VIC SHOP SLU reserves the right to block future purchases in case of repeated chargebacks without justification.

6. DELIVERY

In cases where it is necessary to physically deliver the contracted good, deliveries will be made within the following territory: World.

The estimated delivery time is 2 to 7 days if the product is in stock in Spain, and 7 to 14 days if it is in stock in Germany. Unless the parties expressly agree otherwise, the maximum delivery time will be 30 calendar days from the conclusion of the contract.

For products customized or configured specifically for the customer's vehicle, the processing time may be extended by an additional 7-14 days.

In the event of extraordinary circumstances beyond our control that generate a delay greater than 30 calendar days, the user may choose to keep their order or cancel the purchase and receive a full refund.

If GERMANY VIC SHOP SLU cannot meet the estimated delivery time for reasons beyond the control of the company, the user will be notified and may choose to:

• 1. Maintain the order with a new delivery date.
• 2. Cancel the purchase and receive a immediate and full refund.

In any case, if the delay exceeds 30 calendar days without justified cause, the user will have the right to terminate the contract and an immediate refund of the amount paid, in accordance with article 66 bis of the TRLGDCU.

If it is impossible to deliver the order due to the absence of the User, it could be returned to the warehouse. In this case, the carrier will leave a notice. If the order is finally returned to GERMANY VIC SHOP SLU, the User must assume the costs derived from the return.

If after 7 days from when the order is available for delivery, it has not been able to be delivered for reasons not attributable to GERMANY VIC SHOP SLU, it will be understood that the User wishes to withdraw from the contract, and it will be considered terminated. Consequently, GERMANY VIC SHOP SLU will proceed to refund all payments received by the User, using the same payment method used by this, deducting from the total amount only the return costs derived from non-collection.

The risks that may arise from the products will be borne by the User from the moment of delivery. The User acquires ownership of the products when GERMANY VIC SHOP SLU receives full payment.

In accordance with VAT Law 37/1992, orders will be deemed to be located in the territory of application of Spanish VAT if the delivery address is in Spanish territory except the Canary Islands, Ceuta and Melilla.

7. TECHNICAL MEANS TO CORRECT ERRORS

8. RETURNS AND RIGHT OF WITHDRAWAL

Right of Withdrawal

The User, as a consumer and user, has the right to withdraw from the purchase made on the Website within a period of 14 calendar days from receipt of the order, without the need for justification.

• If the User requests the cancellation of the order before its shipment to the final recipient, but after the product has been purchased and sent from the supplier to GERMANY VIC SHOP SLU, the transportation and management costs incurred up to that point will be deducted from the refund.

After this period, GERMANY VIC SHOP SLU, as part of its commercial policy, may offer at its discretion an extended return policy: If the withdrawal is communicated between the 15th and the 30th, the refund will be made by gift card, for 50% of the amount paid, deducting expenses.

Return conditions

To exercise this right, the User must notify GERMANY VIC SHOP SLU of their decision to withdraw through the spaces provided on the Contact page.

Product status and possible deductions

The product must be returned in the same conditions in which it was delivered. If the product is damaged or lacks original packaging, GERMANY VIC SHOP SLU may apply a reduction in the amount to be refunded (up to 50% for damage to packaging, up to 75% for marks of use).

Exceptions to the right of withdrawal

Returns or cancellations of orders will not be accepted in the following cases:

• “Custom-made” products: Includes those products configured with a chassis number or unique specifications (except manufacturing defects).
• Car cleaning and care products (for safety/hygiene reasons).
• Opened or used oils, creams, paints and liquids.

Return of defective products or shipping error

If the User receives a defective or erroneous product, they must contact GERMANY VIC SHOP SLU immediately. If the package has visible damage, you must notify it on the carrier's delivery note. GERMANY VIC SHOP SLU will evaluate the case and, if appropriate, offer a refund or replacement at no cost to the user (in this case shipping deductions are NOT applied).

Guarantees

All products sold on this website have a 3 year legal warranty from the delivery date, in accordance with Royal Decree-Law 7/2021.

If a product presents a fault, the User must provide reasonable evidence. The warranty only covers manufacturing defects and malfunctions not attributable to the user. It does not cover incorrect installation, improper handling, or external damage.

If the product must be sent for review, Customer will bear initial shipping costs for revision. If after review, it is determined that the product is covered by warranty, GERMANY VIC SHOP SLU will reimburse the customer for these shipping costs. and will assume the costs of returning the repaired or replaced product.

The return of the repaired/replaced item in case it comes under warranty will be sent back in a reasonable period.

GERMANY VIC SHOP SLU will not accept any responsibility or expense for installation, assembly, configuration and/or any other expense derived from the warranty (workshop labor, etc.).

9. DISCLAIMER

Unless otherwise provided by law, GERMANY VIC SHOP SLU will not be responsible for losses that are not attributable to direct non-compliance on its part, indirect losses (lost profits), or damages resulting from improper use or incorrect installation.

However, in the case of original defective products, GERMANY VIC SHOP SLU will be responsible for their repair, replacement, price reduction or refund in accordance with the 3-year legal warranty.

GERMANY VIC SHOP SLU will not assume responsibility for:

• Minimal visual differences (colors on screen vs reality).
• Delays due to force majeure (strikes, natural disasters, etc.).
• Improper use or incorrect installation by unqualified personnel.

10. WRITTEN COMMUNICATIONS AND NOTIFICATIONS

By using this Website, the User accepts that most of the communications with GERMANY VIC SHOP SLU are electronic (email or notices published on the Website). 11. WAIVER

13. ENTIRE AGREEMENT

These Conditions and any document expressly referred to in them constitute the entire agreement between the User and GERMANY VIC SHOP SLU in relation to the object of sale and replace any other pact, agreement or previous promise agreed verbally or in writing by the same parties.

14. DATA PROTECTION

The personal information provided by the user will be treated in accordance with the General Data Protection Regulation (RGPD) and Organic Law 3/2018 on Data Protection and Guarantee of Digital Rights (LOPDGDD). 15. APPLICABLE LEGISLATION AND JURISDICTION
